1. In order to conclude a contract for services with Crypto-Castle, you must be a natural person who is at least 18 years of age and has legal capacity. In the case of a legal entity, the contract must be concluded by a natural person with unlimited legal capacity who is authorized to represent the legal entity in legal transactions. All information you provide when concluding the contract must be complete and truthful. If individual details change, you will inform Crypto-Castle immediately.

2. Requests for services from Crypto-Castle are always made via the website www.crypto-castle.com. To place an order, you must use the order pages provided on the website. On the order pages, you must complete the fields marked as mandatory. To submit the order request, you must also select a payment method and enter your payment details in order to complete the order request by clicking the "Pay now" button.

3. Once you have sent the order, access to the Crypto-Castle will be made available to you immediately on the confirmation page and confirmed by e-mail. This e-mail does not constitute a binding acceptance of the order request.

4. After your order request, Crypto-Castle is free to refuse to conclude a contract with you and to refuse payment. You are not entitled to the conclusion of a contract or an offer.

5. The contract language available for the conclusion of the contract is German and English. You will receive these GTCs via the order form on the website www.crypto-castle.com before the contract is concluded. In addition, Crypto-Castle stores the GTCs and keeps them available at https://www.crypto-castle.com/termsandconditions.

1. The contract for the services shall generally enter into force upon conclusion of the contract in accordance with section 3. The duration of the contract will be agreed individually with you. It generally results from Crypto-Castle's offer to you and ends with the performance of the services you have requested.

2. The right to ordinary termination is excluded. The contract may be terminated by you or Crypto-Castle at any time for good cause. Good cause shall be deemed to exist in particular if force majeure or other circumstances for which Crypto-Castle is not responsible make it impossible to fulfill the contract (epidemics, pandemics, epidemics or quarantine orders excluded).

1. You have a right of withdrawal from Crypto-Castle if you are acting as a consumer. Details on the right of withdrawal and its exercise can be found in the withdrawal policy, Appendix 1.

2. However, you have no right of withdrawal if you have concluded a contract with Crypto-Castle for the provision of services in connection with an event or occurrence that provides for a specific date or period for the provision of these services (§ 312g para. 2 no. 9 BGB).

1. The remuneration for the services is set out in the Crypto-Castle offer to you on the website www.crypto-castle.com. The remuneration includes the services as well as the preparation and follow-up of the services.

2. You will receive an invoice after the conclusion of the contract with Crypto-Castle in accordance with section 3. Unless otherwise stated in the invoice, the payment period for the invoice amount is 14 days from the invoice date.

1. Crypto-Castle's warranty shall be governed by the statutory warranty provisions.

2. Claims for damages due to breach of duty and tort as well as claims for reimbursement of futile expenses are excluded against Crypto-Castle and its vicarious agents, subject to the following exceptions (Sections 7.3, 7.4).

In cases of slightly negligent liability for damages for the breach of a material contractual obligation, the aforementioned exclusion of liability shall not apply, but liability shall be limited to typical and foreseeable damages, subject to the following exceptions (Section 7.4). Essential contractual obligations are contractual obligations whose fulfillment is essential for the proper execution of the contract, on whose compliance you may regularly rely, and whose breach jeopardizes the achievement of the purpose of the contract.

4. The aforementioned limitations of liability (clauses 7.2, 7.3) do not apply if the damage was caused intentionally or through gross negligence. Furthermore, they shall not apply to damages resulting from injury to life, limb or health if Crypto-Castle is responsible for the breach of duty. Furthermore, the limitation shall not apply to damages based on the absence of a warranted characteristic or for which liability is provided for under the Product Liability Act.

1. The content made available as part of Crypto-Castle's services is protected by copyright. Upon conclusion of the contract in accordance with Section 3, Crypto-Castle grants you a non-exclusive, non-transferable right of use to all content and materials that Crypto-Castle makes available to you in connection with the provision of the services.

2. You may only use these contents and materials for your own private purposes within the scope of the respective contractual purpose and may not reproduce them or pass them on to third parties without the consent of Crypto-Castle.

1 Crypto-Castle has a community ("Community") on social networks such as Telegram, Facebook, Instagram, YouTube and TikTok. You can only become a member of the Community if you have a corresponding account on the respective social network.

2. As a community member, you must take into account the interests of the other members of the community.

3. As a community member, you must comply with the terms of use of the social network you are using.

4. It is also important to Crypto-Castle within the framework of the community that the confidential handling of sensitive information obtained within the framework of the community is always maintained among the community members and that the other community members can therefore always rely on the maintenance of confidentiality.

5. Crypto-Castle is entitled to exclude you from the Community if you do not comply with the above provisions.

6. Crypto-Castle is not liable for the content of community members.

Crypto-Castle and you are obliged to maintain confidentiality about all information that you obtain during the term of the contract or the provision of services by Crypto-Castle ("Confidential Information"), unless you release each other from this obligation. This obligation also applies beyond the duration of the contract.

1. Both Crypto-Castle and you shall comply with the requirements of the applicable data protection law, in particular the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG), in the performance of all contracts.

2. For more information on the extent to which Crypto-Castle processes personal data in the provision of its services or the fulfillment of contracts with you, please refer to the Privacy Policy.

The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link in accordance with Article 14(1) of Regulation (EU) No 524/2013: http://ec.europa.eu/consumers/odr. Awakening Association is neither willing nor legally obliged to participate in a dispute resolution procedure before a consumer arbitration board.

1 Crypto-Castle reserves the right to change these rules at any time. Crypto-Castle will notify you of such changes in text form at least 4 weeks before the change comes into effect. If you do not object within 30 days of receipt of the notification, the changes shall be deemed to have been effectively agreed from the expiry of the deadline. In the event of an objection on your part, the contract between Crypto-Castle and you will continue under the previous conditions. Crypto-Castle will inform you of your right of objection and the consequences of your silence in the notification of change.

2. In the event that individual provisions of these GTCs are or become invalid or unenforceable in whole or in part, or in the event that these GTCs contain loopholes, this shall not affect the validity of the remaining provisions of these Game Rules. In place of the invalid, unenforceable or missing provision, such a valid and enforceable provision shall be deemed to have been agreed as would have been agreed, taking into account the purpose of these Terms and Conditions, if the invalidity, unenforceability or absence of the provision in question had been known.

3. The law of the United Kingdom shall apply to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

4. The exclusive place of jurisdiction for all disputes arising from or in connection with these GTCs is London if you are a merchant, a legal entity under public law or a special fund under public law Status: August 2023.
